Service

Under this agreement you will avail the services of homecareneed. service compose the regulation of a technology platform that authorize you, as a individual/third party service provider (working professional) to access and use the homecareneed Website/App(“collectively” homecareneed platform) to:

(i) Arrangement for delivery of service to end-users (ii) complete the payment received by user in favour of services provided by you (iii) take step to increase your earning ability via use of our services (iv) receipt of payment facility to user for the services provided by you to user via homecareneed platform (v) generation of receipt for that service and tax invoice if applicable.

Relation between you and homecareneed 

 These services are only for your commercial use. You agree that between you and homecareneed there is no any contract for employment, and you will give your services as a individual contractor. The relation between both the parties is non exclusive, and both parties are free to enter in such kind of arrangement, What they find suitable, except this, No agency, partnership or joint venture has been formed as a result of the provision of these terms or your services to the users. You won't ask nor homecareneed will give you any kind of supervision, instruction or control for your personalised services being provided to users. You will bear the necessary approval / license / tax registration expenses for providing services to the user by accessing and using the service and you must always have the necessary approval / license / tax registration. You have no right to bound homecareneed in any way. homecareneed is only a platform between you and users. Homecareneed does not provide any service directly to user. The services provided by you to users via homecareneed platform are solely your responsibility.

Your Use of service

You agree that you will follow the relevant rules for opening an account for use of the Homecareneed platform. To register an account, you have to be 18 years of age, you can provide such services or any other document issued by the Government of India or approved by the Government of India or you can provide such services or registration of proposed tax and other personal information such as Correct information of name, address, age, mobile number, email etc. You agree that the identity card / any other document or other information for your account will be kept correct and complete at all times, if you fail to do so, Homecareneed can close or cancel your account and The liability arises from this situation will be payable by you. At any time (before or after opening an account), homecareneed can go through your account related verification and you will have to bear the expenses. Verification of your account will be according to Homecareneed's standards (from time to time Homecareneed will determine according to its internal policies and governing laws). You also agree that you will not allow anyone else to use your account and you will not share your account personal information such as login details, passwords, one time password or other information with someone else. If Homecareneed find any doubts, than as security point of view, your account can be blocked or closed.

Rating

You cannot use more than one account on Homecareneed's platform, if you are found doing so, Homecareneed can close your account without any prior notice and you will be responsible for the loss arising out of this unauthorized use, It will be completely your responsibility. You are also agreeing that you will be responsible for the loss of homecareneed and others arises from this unauthorized use. You also agree that your use of the Services will be subject to the user's minimum rating process. The minimum rating will be communicated to you by Homecareneed via the message / homecareneed platform or by any other means. If your rating is below the minimum limit, your services may be temporarily stopped.

 

 

Account Points (homecareneed points)

Homecareneed will give “hC point “against the amount you will pay in advance. You agreeing that you have to maintain a minimum hc point balance at all time into your account (wallet section) to get the job from users through hc platform. Although you have to pay a platform fee in advance which may be fixed by hc on time interval to get the work via hc platform.

You agree that you have to maintain advance deposit (minimum required “hc points”) into your account at all the time. you also agree that in case of low “hc point” ,you are authorizing homecareneed to deduct the money from service charge coming towards users into homecareneed account and can deposit into you wallet(“hc point”).you can use your “hc point” to purchase any material available on hc platform.

The “hc point” will collapse and seized after one year from starting date of your services, in case there is no activity on that account (hc points ) or unclaimed hc points .after this period of time you can not processed your hc points. 

You also agree that if you "hc points" is less than minimum required ("hc points”), than your “job” (Work) can be affected and it will be entirely your responsibility.

Digital platform charges

If any user or you are paying through online transaction than we will deduct a service charge for digital market place facility.

Text message/other media

On creating an account, you agree that we can send you text messages related to your services/ business operation and you fully agree to receive such text messages. You also agree that we can use any other social media platform/e mail to send any service /business related messages.

Refund/Payment

Through your use of the services, after providing service to the users, Homecareneed helps you to get the amount paid by the users as a amount collection platform. The amount paid by user will be final in respect of your services. Once amount is paid can’t be refunded until/unless homecareneed is not deciding to do so according to these terms & condition.

 The necessary taxes imposed by the government will also apply in this amount. You agree and certify that homecareneed have all rights for assessment of the amount/charges of services/parts/others given on “hc” platform. On your behalf, homecareneed will generate a invoice for the services given by you to user. 

The invoices of services will generate in your name and send to you via “hc platform” or by any other way. This invoice is for your accounting, filing purpose and totally related to you.

 

 

 

Taxation

Homecareneed works as a mediator platform for (by providing the services to user) amount collection from users and get the amount paid to you. You will solely responsible for the accounting, filing, and taxation by taking advice from any legal advisor. As you know that state taxes and central taxes can vary according to local rules so homecareneed cannot or may not advise you related to your liability of taxation. Homecareneed has no responsibility to your tax liability. On behalf of other services (which is not registered) like-cleaning service, homecareneed will pay according to Central Goods and Services Tax (CGST) Act 2017 9(5) and also make a invoice in this regard. Any kind of taxes (direct or indirect) Will be deducted from the payment you receive from users and and given to you after deduction of the same (if applicable). Homecareneed has no responsibility In relation of your tax liability.

 

TDS Deduction   

                                                                                                                                                                                                   TDS on Payment: According  to  Income Tax Act Section 194 ‘O’ : Applicable for e-commerce operator for the sale of goods or provision of services facilitated by it through its digital or electronic facility or platform (Applicable from 01.10.2020).

Homecareneed will deduct TDS @ 1% as per Tax Deducted at Source, (TDS) under section 194 o of Income Tax Act. In this regard you agree to furnish your PAN or Aadhar. If you do not furnish your PAN or Aadhar, TDS must be deducted at the rate of 5%, as per provisions of Section 206AA.

Helper

You are informed that as long as homecareneed is not authorising another person, you are not allowed to add him as an assistant. Until then, you cannot take any of your colleagues or others to work with you. If Homecareneed allows your colleague. Even then you will be responsible for any kind of untoward problem.  Homecareneed allows you and your associate to work under these terms and conditions:  Your colleague must be at least 18 years old. You and your support should have the same gender.

At the time of verification and registration process of your helper you have to submit related documents like as: aadhar/pan or any other document (registered under government of India) asked by homecareneed. Homecareneed will have all rights reserved, at its discretion, to verify the document of helper and you are liable to pay for the charges of verification process.

License

Under the rights of these terms homecareneed will provide you with limited, non-transferrable, revocable, non exclusive license which you can use for(1) for your use of service, through application to access and use of services on your personal device and;(2)for  use of services and other related facility made available on hc platform. but all these rights will be for your commercial use only. If there is any rights which is not mentioned, will be under rights of homecareneed and its licensee.

 

 

Prohibition of discrimination

Homecareneed prohibit the discrimination of partners/user on the ground of species, religion, cast, creed, race, age, color, sex, political opinion, social origin, birth place, gender identity or protected under law or of any other quality. Prohibition of discrimination includes- Refusal to give services on the basis of such specialties (not limited to them). If homecareneed finds violation of this prohibition from your side, you will be barred from using the services of the homecareneed platform. By jurisdiction in some way, or by law states that some person related to special category will given services/facility by or for them. The services/facility in compliance with these laws and in related manner is accepted.

Liabilities

 

you agrees that neither homecareneed nor its group companies, directors, officers ,professionals or employee shall be liable for any direct or /and indirect or/and incidental or/and special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and your use of  services  or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Company has been advised of the possibility of such damages.

You further agrees that homecareneed shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct /and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

You agree that homecareneed shall not be responsible or liable to you, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company's total liability to the partner for all damages or/and losses or/and causes of action exceed the amount paid by you to Company, if any, that is related to the cause of action.

 

 

 

Indemnity

The partner unilaterally agree to indemnify and hold harmless, without objection, homecareneed, its officers, directors, employees, and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from your use of homecareneed.com / App or your breach of the terms/policy.

Management programme

On accepting/accessing the services of homecareneed (‘hc’) platform, and before getting the ‘work’ on your personal device via mobile application (homecareneed app),you have to attend the office of the homecareneed for management programme, equipment inspection, documentation and for others queries too. This programme makes you able about the use of application and use of services on homecareneed platform.

 

Third Party Terms 

Homecareneed and its Entities/affiliates may provide any third party services through homecareneed Platform. You understand that we are not providing that service and you are availing those services of third party on their terms, you may be required to share some information in favour of availing such services being provided by any third party on homecareneed Platform. Homecareneed is not liable for any loss/damage of data to on the basis of information collected from you by any third party Website/App, and we cannot compensate you for the actions of any third party.

 

Disallowance

You can't do the following things related to Any part of the services:-Such as the removal of any information related to copyright business or ownership. Distribution, licensing, leasing, sale, rearrangement, transfer, performance in public, broadcasting, broadcasting or manufacturing on the Internet, or in any other way, use or benefit, or in any other way, other than services permitted by Homacareneed , inappropriate To take advantage and make amends or prepare parallel work related to it. Services cannot be disbanded or demobilized in any way except when approved by law. Adding link to any part of the services, in any way disrupting the way of any work connected with it, mining any part of the services, using the data, operating or operating system of any part of the services ,Attempting to interrupt or disturb or creating or transmit scripts.

 

 

Ownership

All services and related rights available therein are subject to the ownership of Homecareneed, and under the licensees of Homecareneed. by using its services or the Terms do not grant you any rights. except the limited license, Services and other than the related rights mentioned in it OR in any manner the name of homecareneed, services, logo, name of services or business name or marks of Licensees Concerning rights.

 

Discontinuation of Services

Homecareneed may cancel or terminate your use of services/Web/App of homecareneed platform at any time, if homecareneed find any breach by you of these terms /privacy policy or any misuse of homecareneed platform in any context. Homecareneed, at its discretion, can terminate your use of Web/App or services. Homecareneed may delete any details, content, related to your account, if your use of service/Web/App is being terminated by homecareneed. Homecareneed have no liability towards user/you/yours or any others.

Reform (modification of “terms & condition”)

HOMECARENEED HAS ALL THE RIGHTS RESERVED , at its discretion ,to change, modify, add, remove any parts of these terms at any time without any prior notification to user and the modified reformed terms shall be  effective immediately. Your continuation of use of service/web/App will give your consent towards acceptance of these reformed terms.

APPLICABLE GOVERNING LAW (LEGAL)

This agreement (terms & condition) shall be governed by government of India. These terms And condition is subject of jurisdiction under Ghaziabad Uttar Pradesh India. All disputes Shall be resolved under the same jurisdiction under related law provisions. Our Failure of Enforcement to any provision of these terms and condition or any services will not be Considered as waive off of these rights. Any dispute between parties/user/working partners, services Pertaining to these terms and condition as well as for any service provided by homecareneed on Website/App shall be subject to jurisdiction of law under Court of Ghaziabad Uttar Pradesh India. The terms and condition including the usage of service (agreement) and the privacy policy can be modified Or change or delete or rearranged in any manner at any time without notification.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall homecareneed or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website/App be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.
